PNC Seeks To Invalidate ING 'Orange Ball' Trademark

Law360 (February 9, 2009, 12:00 AM EST) -- PNC Financial Services Group Inc. is trying to invalidate one of three trademarks belonging to rival ING Direct Bancorp and get the company's entire complaint dismissed in an ongoing infringement dispute over “orange ball” designs.

In counterclaims filed Friday, PNC said ING's U.S. Trademark Registration Number 3,068,848 should be declared invalid because it was intended to be used in relation to credit cards, and ING doesn't issue credit cards, according to documents in the U.S. District Court for the District of Delaware.
