Miners Union Gets Partial Win Over MSHA Rule

Law360 (February 11, 2009, 12:00 AM EST) -- The United Mine Workers of America has partially won a challenge to a final rule issued by the federal Mine Safety and Health Administration, with the U.S. Court of Appeals for the D.C. Circuit finding some of the provisions concerning mine rescue teams at odds with the underlying legislation.

On Tuesday, the D.C. Circuit granted the union's petition for review in part, knocking down the final rule issued by the MSHA in February 2008 in relation to the 2006 Mine Improvement and New Emergency Response Act....
