Celgard Can't Salvage Battery Patent Claims At Fed. Circ.

Law360, New York (December 13, 2016, 7:50 PM EST) -- The Federal Circuit upheld the Patent Trial and Appeal Board's invalidation of several claims in a Celgard LLC patent covering lithium battery technology, which had been asserted in district court against LG Chem Ltd.

In a one-line order, the appeals court affirmed PTAB's October 2015 decision that LG Chem had shown certain claims in the patent were made obvious by earlier inventions and were thus invalid.

During its appeal, Celgard had argued that LG Chem failed to present the necessary evidence at PTAB to support such a finding. Representatives for the company could not immediately be reached for comment after normal...
