4th Circ. Blasts Away W.Va. Coal Mining Injunctions

Law360 (February 13, 2009, 12:00 AM EST) -- A federal appeals court on Friday overturned a West Virginia district court's ruling requiring the U.S. Army Corps of Engineers to conduct more thorough environmental scrutiny prior to issuing Clean Water Act permits for mountaintop coal mines.

The 2-1 ruling in the U.S. Court of Appeals for the Fourth Circuit marks a victory for West Virginia coal mine operators, who face extensive opposition from a number of environmental advocacy groups in the widely watched case.
