Manufacturers, Retailers, Importers — Beware CPSIA

Law360, New York (February 17, 2009, 12:00 AM EST) -- As of Feb. 10, 2009, the Consumer Product Safety Improvement Act of 2008 (the “CPSIA”) imposed new limits on lead, phthalates and other substances in children’s and consumer products that affect thousands of retailers, importers and manufacturers.

The CPSIA fundamentally changed the scope and breadth of the well-known Consumer Product Safety Act (the “CPSA”).

Important changes include a requirement for certifications relating to children’s products stating that, inter alia, the children’s products meet all regulations of the amended CPSA. This includes compliance with more stringent requirements...
