Fed. Circ. Backs PTAB Nix Of Gas Leak Detector Patent Claims

Law360, New York (January 10, 2017, 4:54 PM EST) -- The Federal Circuit on Tuesday upheld a Patent Trial and Appeal Board decision that invalidated part of two Leak Surveys Inc. patents related to a system for detecting gas leaks, preserving a victory for Oregon camera company and accused infringer FLIR Systems Inc.

Just one day after hearing oral arguments in the case, the appeals court affirmed the PTAB’s September 2015 decision in a one-line order. The board had found in inter partes review that several claims in the two patents were invalid because they would have been obvious.

On appeal, Leak Surveys said the board “fundamentally misapprehended” the technical problem...
