Judge Refuses To Quash Suit Against Ohio EPA Chief

Law360 (February 19, 2009, 12:00 AM EST) -- A federal judge on Wednesday denied a motion to dismiss a Sierra Club lawsuit that accuses Ohio Environmental Protection Agency Director Christopher Korleski of violating the Clean Air Act by failing to enforce federally mandated air pollution regulations.

Korleski filed the motion to dismiss in November in the U.S. District Court for the Southern District of Ohio, arguing that the complaint failed to state a claim for relief.
