Fed. Circ. Reopens Enzo DNA Detection Patent Case

Law360 (February 20, 2009, 12:00 AM EST) -- An appeals court has reopened a patent case between Enzo Biochem Inc. and the former Applera Corp. over DNA detection technology after finding that the lower court failed to resolve one of Applera's counterclaims.

The U.S. Court of Appeals for the Federal Circuit granted Enzo's petition for writ of mandamus requiring the district court to enter final judgment, almost a year and a half after the judge closed the case.
