The New Mass. Data Protection Law

Law360 (February 20, 2009, 12:00 AM EST) -- The Commonwealth of Massachusetts enacted new data breach security regulations, which go into effect on Jan. 1, 2010. These regulations apply to any person who owns, licenses, stores or maintains personal information of a resident of the Commonwealth.

The regulations have two primary requirements, which are to:

1) develop, implement, maintain and monitor a comprehensive, written information security program applicable to any records containing such personal information; and
