Judge Keeps TriCor Competition Suit Alive

Law360, New York (February 23, 2009, 12:00 AM EST) -- A federal judge has refused to dismiss the bulk of a suit that Ethypharm SA France brought against Abbott Laboratories alleging it engaged in anti-competitive conduct in connection with a patent fight over its lucrative cholesterol drug TriCor.

In a ruling Friday, Judge Sue L. Robinson of the U.S. District Court for the District of Delaware dismissed Ethypharm's claims of an unlawful restraint of trade under common law, keeping the majority of the case alive.
