PTAB Says Sipco Comminication Patent Eligible For Review

Law360, New York (January 24, 2017, 8:50 PM EST) -- The Patent Trial and Appeal Board agreed Monday to review a Sipco LLC patent that covers a system for remotely communicating information, rejecting arguments the patent was ineligible for the America Invents Act's covered business method review program.

Emerson Electric Co. sought review under the program for challenging financial patents after it was sued for infringement. The PTAB, agreeing the patent was related to a financial product or service, said Emerson had shown various claims were likely invalid.

In its decision, the board noted the patent repeatedly describes the invention in the context of selling goods or providing banking services....
