ConAgra Sues Insurer For Salmonella Coverage

Law360, New York (February 24, 2009, 12:00 AM EST) -- As the claims related to the salmonella outbreak from ConAgra Foods Inc.’s peanut butter continue to pour in, the food manufacturer has sued its umbrella insurer, Lexington Insurance Co., for breach of contract, alleging that it is liable for those claims.

Filed on Thursday in the New Castle County Superior Court of Delaware, the lawsuit alleges that Lexington has failed to pay for salmonella-related liability claims covered by an expansive commercial umbrella liability policy ConAgra purchased in 2006.
