Monsanto Wins Patent Interference Vs. Dow Chemical

Law360, New York (February 4, 2004, 12:00 AM EST) -- The U.S. Patent and Trademark Office has ruled that scientists from agricultural biotech company Monsanto Co. were the first to invent a technology for protection of plants against insect damage, ending an eight-year dispute with a unit of Dow Chemical.

In a 200-page decision, the USPTO’s Board of Patent Appeals and Interferences ccluded that Monsanto invented the the technology for synthetic "Bt" genes in plants, dealing a blow to Mycogen Seeds, now a Dow AgroSciences unit.
