Enviro Groups Say Dominion Plant Unconstitutional

Law360 (February 25, 2009, 12:00 AM EST) -- A handful of environmental groups have challenged a state law permitting construction of a Dominion Virginia Power plant in Virginia, arguing that the state's approval of the project is unconstitutional because it requires the plant to burn Virginia coal.

At a hearing held Wednesday before the Supreme Court of Virginia, attorneys for the Southern Environmental Law Center told the state's highest court that the Virginia State Corporation Commission's approval for energy giant Dominion to build a power plant violates the U.S. Constitution's commerce clause.
