6th Circ. Upholds EPA Decision On Ky. Plant Permit

Law360, New York (February 26, 2009, 12:00 AM EST) -- A federal appeals court has denied a Sierra Club request to review a decision by the U.S. Environmental Protection Agency declining to object to an air pollution permit granted to a Kentucky power plant, saying the agency had reasonably interpreted the Clean Air Act and was not automatically required to issue an objection in this case.
