India's Supreme Court Rules On Preliminary Injunctions In IP Lawsuits

Law360, New York (February 5, 2004, 12:00 AM EST) -- The Supreme Court of India has issued a ruling that will help copyright, patent and trademark owners obtain faster preliminary injunctions against alleged infringers.

Clearing up a legal gray area, the court ruled last month that a delay in filing legal action does not necessarily warrant the denial of an injunction.

The ruling was welcomed by industry groups that are fighting rampant piracy in India of industrial and consumer goods as well as pharmaceuticals.
