Massey Judicial Bias Case Goes Before High Court

Law360, New York (March 2, 2009, 12:00 AM EST) -- Judges should be forced to recuse themselves from cases if there is even the appearance or possibility of bias, counsel for West Virginia coal mining company Harman Mining Co. argued before the U.S. Supreme Court Tuesday.

That was the center of oral arguments before the high court in the Caperton v. Massey Coal case, which grows around massive contributions made in a state Supreme Court election in West Virginia that occurred prior to a case involving Harman and Massey before the state Supreme Court.
