Bill Aims To Overturn Bush-Era Mining Rule

Law360 (March 5, 2009, 12:00 AM EST) -- Rep. Frank Pallone Jr., D-N.J., and 116 colleagues introduced legislation Wednesday in the U.S. House of Representatives that would once again prohibit coal miners from dumping industrial waste into rivers and streams.

The bill, known as the Clean Water Protection Act, would overturn a 2002 Bush administration rule that expanded the definition of “fill material” to include mining wastes and other pollutants. Before that, a prohibition on using waste as fill had been in place since 1977.
