Decree Forces EPA To Answer Cemex Permit Objection

Law360, New York (March 5, 2009, 12:00 AM EST) -- Under a consent decree signed Wednesday, the U.S. Environmental Protection Agency has agreed to rule by April 20 on an environmental group's petition objecting to a proposed permit for a Cemex Inc. cement plant in Colorado.

U.S. District Judge Richard W. Roberts of the District of Columbia on Tuesday signed an order approving the consent decree between EPA and WildEarth Guardians, compelling the agency to respond to the green group's objection to the proposed Cemex permit under the Clean Air Act.
