Dems Push To Undo Riegel After Wyeth Ruling

Law360 (March 5, 2009, 12:00 AM EST) -- A day after the U.S. Supreme Court ruled that federal law did not preempt state product liability claims against drugmakers, Democrats in Congress have reportedly moved to overturn an earlier high court ruling that protected medical device makers from the same claims.

Building on the momentum of Wednesday's decision, Democrats on Thursday reintroduced a bill to restore the rights of patients to seek state common law remedies for injuries or death caused by defective medical devices, according to The Associated Press.
