Marsh & McLennan Wins Wind Damage Policy Spat

Law360 (March 9, 2009, 12:00 AM EDT) -- A Florida condominium company has lost a lawsuit claiming that insurance broker Marsh & McLennan Cos. Inc. failed to secure an adequate wind damage policy covering the damages caused by hurricanes Frances and Jeanne.

Judge Daniel T.K. Hurley of the U.S. District Court for the Southern District of Florida granted Marsh’s motion for summary judgment on March 3, dismissing Tiara Condominium Association Inc.’s claim that the broker did not recommend an occurrence-based policy to protect against the wind damage of two hurricanes.
