Judge "Erred" In Granting Discovery Of Citizenship Status

Law360, New York (August 23, 2006, 12:00 AM EDT) -- Adding steam to a national trend in employment litigation, a federal judge in Minnesota has ruled the immigration status of a restaurant and bakery worker won’t play a part in the employee’s case alleging sexual harassment against a supervisor.

The ruling, by Judge John R. Tunheim with the U.S. District Court for the District of Minnesota, called an earlier decision by a magistrate judge "contrary to law" and said it resulted in an improper analysis of case law.
