NLRB Largely Clears Duquesne Adjuncts For Unionization

Law360, New York (April 11, 2017, 4:17 PM EDT) -- Duquesne University in Pittsburgh was rebuffed on Monday in its bid to convince the National Labor Relations Board that a union election in which adjunct faculty members voted for union representation should be vacated because the school’s Catholic affiliation deprived the board of jurisdiction.

In a split ruling, board members Lauren McFerran and Mark Gaston Pearce held that the National Labor Relations Act permits the board to have jurisdiction over most adjunct faculty members at Duquesne who are seeking to unionize.
