Qwest's Nacchio Loses Bid To Toss SEC Claims

Law360, New York (March 13, 2009, 12:00 AM EDT) -- A judge overseeing action by the U.S. Securities and Exchange Commission against former Qwest Communications International Inc. CEO Joseph Nacchio has denied the erstwhile bigwig's motion to toss much of the complaint on the grounds that the regulator had invoked the state secrets privilege and barred him from adequately defending himself.

In a 25-page order issued Thursday, Judge Marcia Krieger of the U.S. District Court for the District of Colorado also rejected various dismissal motions by four other Qwest executives named in the SEC's second amended...
