Conn. High Court Sheds Light On 'ABC' Test Application

By Eric Sussman, Day Pitney LLP (April 25, 2017, 10:39 AM EDT) -- Worker misclassification issues have been the subject of significant attention by the courts and the U.S. Department of Labor in recent years. On March 21, 2017, the Connecticut Supreme Court released an important decision concerning the application of the "ABC" test, which governs whether an employment relationship exists for purposes of the Unemployment Compensation Act. To be considered an independent contractor under the test, an individual must satisfy the following requirements: (A) the individual has been and will continue to be free from control and direction in connection with the performance of services; (B) the service is performed either outside the usual course of the business for which the service is performed or is performed outside of all of the places of business of the enterprise for which the service is performed; and (C) the individual is customarily engaged in an independently established trade, occupation, profession or business of the same nature as that involved in the service performed. Conn. Gen. Stat. § 31-222(a)(1)(B)....
