Amerisource Must Pay Fees In Merger Suit: Court

Law360 (March 16, 2009, 12:00 AM EDT) -- Wholesale pharmaceutical distributor AmerisourceBergen Corp. must reimburse the former stockholders of a subsidiary for legal fees in a suit over a breach of a merger agreement, Delaware’s highest court has ruled.

Res judicata and the state statute of limitations did not bar the appellants' claim for relief, Justice Randy Holland of the Delaware Supreme Court wrote in the opinion, which reversed and remanded a state superior court decision on Thursday.
