Danish Drugmaker Hit With IP Suit Over Cancer Test

Law360 (March 16, 2009, 12:00 AM EDT) -- AsymmetRx Inc. and Harvard University have filed a patent infringement lawsuit accusing Danish drugmaker Dako Denmark AS of infringing patents related to the first U.S. Food and Drug Administration-approved diagnostic test kit for prostate cancer.

The lawsuit, filed Friday in the U.S. District Court for the District of Massachusetts, alleges that Dako and its North American subsidiary infringed two patents for p63-specific antibodies used in prostate cancer diagnosis by selling the antibodies in the U.S.
