WildEarth To Sue EPA Over Interstate Air Pollution

Law360, New York (March 17, 2009, 12:00 AM EDT) -- Environmental nonprofit group WildEarth Guardians has notified the U.S. Environmental Protection Agency of its intent to sue over the agency's alleged failure to address interstate transport of air pollution in seven Western states.

The notice of intent to sue, which was sent to EPA Administrator Lisa Jackson on March 11, accuses the agency of failing to promulgate a federal implementation plan within two years of finding that California, Colorado, Idaho, New Mexico, North Dakota, Oklahoma and Oregon had failed to submit state plans to address transportation...
