Fifth Third, Ex-Employee Strike Deal In OT Action

Law360, New York (March 18, 2009, 12:00 AM EDT) -- A federal judge on Tuesday approved a settlement between Fifth Third Bank and a former employee who had filed a putative collective action accusing the bank of deliberately misclassifying her position as exempt in order to deny her and other workers overtime pay.

The bank filed a notice of settlement in the U.S. District Court for the Middle District of Florida following court-ordered mediation, according to court documents.

Details of the settlement were not made public, and the parties could not immediately be reached for comment...
