Finnegan Didn't Commit Legal Malpractice: Court

Law360, New York (March 19, 2009, 12:00 AM EDT) -- Washington, D.C.’s highest court affirmed Thursday that intellectual property firm Finnegan Henderson Farabow Garrett & Dunner LLP did not commit legal malpractice when it failed to annul a $20 million punitive damage award against former client Biomet Inc.

A three-judge panel of the District of Columbia Court of Appeals said Finnegan made a “reasonable tactical litigation decision involving an unsettled point of law” when it decided not to challenge the punitive damage award as constitutionally excessive during its initial appeal.
