11th Circ. Revives JC Penney Age Bias Case

Law360, New York (March 19, 2009, 12:00 AM EDT) -- A federal appeals court has breathed new life into an age discrimination case a decorator filed against J.C. Penney Co. Inc., vacating a summary judgment ruling and sending the case back to a district court for further proceedings.

The U.S. Court of Appeals for the 11th Circuit handed down a short decision on Tuesday, saying disputed issues of material fact precluded summary judgment in the case decorator Judith Bunnell brought against J.C. Penney in 2007.
