Class Decertified In Qwest Call Center OT Suit

Law360, New York (March 19, 2009, 12:00 AM EDT) -- Finding that the plaintiffs can't be termed similarly situated, a federal judge has decertified a class of current and former Qwest Communications International Inc. call center workers who claim that Qwest ran afoul of federal law by failing to pay them overtime wages.

Judge Roslyn Silver of the U.S. District Court for the District of Arizona issued an order on Tuesday granting Qwest's bid to decertify the class, which was conditionally certified in May 2007.
