PTAB Won't Review Potting Machine Patent In Rivals' Dispute

By Matthew Bultman (June 15, 2017, 3:36 PM EDT) -- The Patent Trial and Appeal Board on Wednesday declined to review a patent for a potting machine that is at the center of a dispute between Agrinomix LLC and a rival horticulture company, after finding most of Agrinomix's arguments relied on evidence already considered by a patent examiner.

Agrinomix filed a petition for inter partes review of the patent after it was accused last year of copying Mitchell Ellis Products Inc.'s EZ Potter potting machine. Agrinomix said the patent was invalid because it was obvious.

All but one of its arguments relied on a combination of references that included a 1977...
