Fla. Court Reinstates Conspiracy Claims Against TD Bank

Law360, Miami (June 29, 2017, 8:33 PM EDT) -- A Florida appeals court on Wednesday reinstated claims by a limited liability company that its investment in a warehouse park was decimated after TD Bank NA and others conspired to prop up a Mercantile Bank loan portfolio during the sale of the regional bank to TD.

In a reversal of its December 2016 decision affirming the dismissal of the claims, Florida's Third District Court of Appeal said the facts alleged by plaintiff MP LLC are “more than sufficient to withstand dismissal” and ordered the trial court to revive the suit.
