Skechers Denied PTAB Review Of Several Nike Shoe Patents

Law360, New York (July 7, 2017, 6:35 PM EDT) -- The Patent Trial and Appeal Board on Thursday agreed to review the validity of two Nike Inc. patents covering sneaker designs, but rejected Skechers USA Inc.’s request for inter partes review of five other Nike patents that it has been accused of infringing.

In a series of decisions, the PTAB said that the California-based Skechers had shown it was likely to succeed in arguing that two of Nike’s patents for sneaker soles were invalid because they were obvious. It wasn’t convinced Skechers would have the same success challenging the others.
