4th Circ. Upholds Md.’s Funeral Home Law

Law360, New York (March 27, 2009, 12:00 AM EDT) -- In a setback for a suit claiming Maryland’s restrictions on funeral home ownership are anti-competitive, a federal appeals court has found the limitations serve a key purpose of safeguarding the public and do not unjustifiably burden interstate commerce.

The U.S. Court of Appeals for the Fourth Circuit on Friday overturned part of a lower court’s decision that the Maryland Morticians and Funeral Directors Act’s licensing requirements violate the commerce clause of the U.S. Constitution, and affirmed the remainder of the court’s ruling that the law does...
