5th Circ. Lets Lilly Off Hook In Zyprexa Suicide

Law360, New York (March 31, 2009, 12:00 AM EDT) -- After a spate of bad news for drugmaker Eli Lilly & Co. over its anti-psychotic drug Zyprexa, a federal appeals court has affirmed a lower court's dismissal of claims that Zyprexa was responsible for a man's suicide.

In a per curiam ruling filed Monday, the U.S. Court of Appeals for the Fifth Circuit found that plaintiff Beatriz Ebel had not provided conclusive evidence that Eli Lilly's failure to provide adequate warning about the potentially severe side effects of Zyprexa — which her husband, Philip Ebel, had...
