Energy Co. Sues Forest Service Over Drilling Rule

Law360, New York (April 1, 2009, 12:00 AM EDT) -- An energy company has fired off a suit against the U.S. Forest Service, claiming it is illegally blocking energy firms from drilling for oil and gas in the Allegheny National Forest even though they own development rights.

Catalyst Energy Inc. brought its suit in the U.S. District Court for the Western District of Pennsylvania on Friday, accusing the Forest Service of imposing a requirement that companies cannot drill until they obtain a “notice to proceed,” but refusing or delaying the issuance of the notices.
