3rd Circ. Upholds Urban Outfitters' Trademark Suit Win

Law360, New York (April 1, 2009, 12:00 AM EDT) -- A federal appeals court has affirmed an infringement ruling in favor of Urban Outfitters Inc. and against BCBG Max Azria Group Inc. in a lawsuit over Urban Outfitters' “Free People” mark, but has remanded the case to the district court to reconsider the granting of attorneys' fees under the “exceptional case” doctrine.
