Claims Pared In ITT Superfund Suit V. BorgWarner

Law360 (April 2, 2009, 12:00 AM EDT) -- ITT Industries Inc. will be able to pursue cost recovery claims against BorgWarner Inc. in relation to one Superfund site in Bronson, Mich., but not a second site involved in the environmental dispute, a federal judge has ruled.

Judge Robert Holmes Bell of the U.S. District Court for the Western District of Michigan on Tuesday denied BorgWarner's bid for summary judgment, rejecting arguments that ITT needed to show the automotive supplier was responsible for the contamination that led to ITT's cleanup costs.
