DC Circ. Pauses CPP Litigation For 2 More Months

Law360, New York (August 8, 2017, 9:24 PM EDT) -- The D.C. Circuit on Tuesday postponed litigation over the validity of the Clean Power Plan for 60 more days, granting the U.S. Environmental Protection Agency’s request for more time to review its options about what to do with the Obama-era rule.

In a brief order, the appeals court gave the EPA the break it sought and ordered it to submit status reports at 30-day intervals. The agency in June transmitted to the Office of Management and Budget’s Office of Information and Regulatory Affairs a draft proposed...
