ITC Judge Finds Sinochem Infringed Coolant Patent

Law360 (April 2, 2009, 12:00 AM EDT) -- A U.S. International Trade Commission judge has upheld an earlier finding that Sinochem Modern Environmental Protection Chemicals (Xi'an) Co. Ltd. imported refrigerants that infringed INEOS Fluor Holdings Ltd.’s patent covering a manufacturing process for coolant.

In a remand determination, Chief Administrative Law Judge Paul J. Luckern on Wednesday affirmed a final initial determination that China-based Sinochem violated Section 337 of the Tariff Act and recommended a limited exclusion order barring its infringing refrigerants from entering the United States.
