Plant Owner Must Repay Insurer For Crane Fire: 10th Circ.

By Jeff Sistrunk (August 14, 2017, 9:18 PM EDT) -- The owner of a gas processing plant must repay a crane rental company's insurance carrier for the cost to fix a crane damaged in a fire at the facility, the Tenth Circuit ruled Monday, holding that the insurer can maintain its claim under Colorado law.

Higby Crane Services LLC had obtained a commercial general liability policy with National Interstate Insurance Co. to cover risks in connection with its work for Colorado-based DCP Midstream LP, with DCP named as an additional insured.
