Sierra Club's Suit Over Coal Plant Emissions Tossed

Law360, New York (April 7, 2009, 12:00 AM EDT) -- A federal judge has thrown out a lawsuit by the Sierra Club accusing the owners of a South Dakota coal-fired power plant of failing to obtain necessary permits and violating emissions limitations, ruling that the environmental group's claims weren't brought within the statute of limitations.

In a memorandum and opinion issued Monday, Judge Charles B. Kornmann of the U.S. District Court for the District of South Dakota agreed with defendants Otter Tail Power Co., MDU Resources Group Inc. and NorthWestern Corp. that the Sierra Club's claims...
