DuPont Launches Attack On $400M Zinc Smelter Ruling

Law360, New York (April 8, 2009, 12:00 AM EDT) -- DuPont Co. is reportedly urging the West Virginia Supreme Court to overturn a nearly $400 million toxic tort verdict against it on the grounds that the proceedings surrounding the trial were rife with various errors that warrant a reversal.

The chemical company's bid came during oral arguments before the high court Tuesday stemming from the verdict in a class action in which DuPont was accused of contaminating the area around a former zinc-smelting plant and then lying about the health risks.
