Nationwide Off Hook For CPB Contract Spat: 3rd Circ.

Law360, New York (April 14, 2009, 12:00 AM EDT) -- Finding that the delivery of a defective nutritional supplement to a customer is not an “occurrence” under a commercial general liability policy issued by Nationwide Mutual Insurance Co., an appeals court has affirmed that Nationwide need not defend and indemnify supplement supplier CPB International Inc. in a breach of contract suit.

The U.S. Court of Appeals for the Third Circuit handed down the ruling against CPB on Tuesday, upholding a district court's ruling that the underlying claim was not covered by the terms of Nationwide's policy...
