8th Circ. Revives Hartford's $3M Case V. Shipping Co.

Law360, New York (April 15, 2009, 12:00 AM EDT) -- A federal appeals court has revived a subrogation lawsuit against shipper TransGroup Express Inc. brought by Hartford Fire Insurance Co. to recover almost $3 million it paid out for a kickback scheme between the owner of a TransGroup affiliate and a restaurant chain shipping manager.

The U.S. Court of Appeals for the Eighth Circuit on Tuesday reversed and remanded the case to the lower court after finding a district judge erred in granting summary judgment to TransGroup and in tossing Hartford’s motion for summary judgment....
