Professor's Sex Bias Claim OK'd Following Ledbetter

Law360 (April 22, 2009, 12:00 AM EDT) -- A professor's claim that Jackson State University denied her tenure because of her sex won't be time-barred because that decision affected her compensation and falls under the newly enacted Lilly Ledbetter Fair Pay Act, a federal judge has ruled.

Judge Tom S. Lee of the U.S. District Court for the Southern District of Mississippi ruled Friday that professor Laverne Gentry can pursue her denial-of-tenure claim even though it occurred in 2004 because it constituted a compensation decision.
