High Court Asked To Hear Reverse Payments Case

Law360 (April 24, 2009, 12:00 AM EDT) -- Attacking a 2008 ruling on reverse payments from the U.S. Court of Appeals for the Federal Circuit, a group of professors and organizations is urging the nation's highest court to clarify the legally controversial method of settling patent disputes as it relates to antitrust law.

The central question in a friend of the court brief filed Friday in the U.S. Supreme Court is "whether an agreement by a patent owner to pay a potential competitor not to enter the market is illegal."
