ND Can’t Challenge EPA Drilling Waste Deal At DC Circ.

Law360, Washington (November 28, 2017, 12:25 PM EST) -- A D.C. Circuit panel ruled Tuesday that just the possibility of adverse regulation isn’t enough to permit North Dakota to intervene in court and challenge a consent decree with environmental groups under which the U.S. Environmental Protection Agency agreed to review and potentially update drilling waste disposal rules.
